The Transformation of American Federalism
American Federalism 1787-1837
Federalism: this essentially refers to the working agreement between the state and federal governments delineating the division of powers, duties, and responsibilities.
Dual federalism: Having been in use until the conclusion of the 1930s, this was the first form of federalism in the US and it worked well to delineate the responsibilities between individual states and the federal government. In essence, it created layers of separation that ensured smooth operation of both federal and state governments with minimal jurisdictional issues.
10th Amendment: As a measure of further ensuring the federal and state governments did not clash, this amendment reiterated the sovereignty of individual state governments by declaring that any powers that were not Constitutionally awarded to the federal government remained a reserve of said individual states. This further elaborated the layer cake federalism that existed in the US.
