My Court Watch Experience
One day I had the opportunity to observe cross-examination and direct examination of the last witness on the prosecution's side. It was Investigator Salvatore of the New York Police Department. He was testifying of his interview of the defendant as well as the statement that the defendant had given on the offenses in question. I also had the chance to observe the defense counsel’s motion conducted for a discussion and trial order of dismissal among the attorneys and judges on the instructions that were to be issued to the jury before any further deliberation was made.
However, the courtroom was way much smaller than I had expected; maybe I had expected too much given that it was my first time. I found a place next to the defendant's family, making me a bit uncomfortable. I felt uneasy because the courtroom did not have any other spectators. Next to the prosecutor, there was a large cart that contained physical evidence in both paper and plastic bags. It was so large that it occupied an ample space considered that the area was limited.
I also noticed that the judge had everything under his control, and there were proper coordination and organization within the courtroom. This created an enabling environment, and the proceedings moved forward with efficiency. He was distinct and clear when he spoke, and everyone in the courtroom could hear him. However, some of his comments and facial expressions showed his impatience when the defense attorney fumbled during cross-examination. His anger and frustration were understandable, but I felt it was inappropriate and unprofessional for the judge to let out such emotions in the presence of the jury.
There was a big contrast between the prosecutor and the defense attorney. The prosecutor appeared very composed, brusque, and confident, to the point that she could easily be mistaken for rudeness. She neither shuffled her papers not took too long to consult her, not during the questioning. She was very concise and direct in the manner of questions that she asked. Her dressing, low heels, and a conservative dark suit made her appearance somewhat official and professional. Her performance was top-notch as well. I admired her professionalism and mastery of the field and wished to be like her when I eventually venture into practice.
On the contrary, the defense attorney was somewhat disorganized and appeared unsure of what he was saying. He was such a disappointment, and I was very unimpressed by his presentation. He also took long pauses and reshuffled papers for over five minutes between questions. This made most of losing focus of the preceding and the questioning.
