Facts: L.B. Sullivan is one of the three elected commissioners of the City of Montgomery. He supervises four departments: fire, police, cemetery, and scales. He complains against four petitioners, Negroes, Alabama clergypersons, New York Times Company, and the corporation that publishes New York Times Daily. Sullivan complains that these people had libeled him through a newspaper that ran a full-page advertisement regarding Martin Luther King, Jr. Sullivan assumed that the allegations against the Montgomery police personally defamed him. The advertisement stated alleged police actions against students who participated in a civil rights demonstration. Sullivan asserted that he was the subject of the statements because one of his responsibilities was to oversee the police force.
