Many people would believe that organ donation policies are always ethical and altruistic in nature. This stems from the fact that the end-result of these acts is providing new organs to patients who need such to survive. However, more in-depth scrutiny of the two acts – Uniform Anatomical Gift Act 1986 and 2006 – has various implications that suggest both advantages and disadvantages for the stakeholders. In this article, I would like to discuss these factors in greater detail.
One of the main contentions of the Revised UAGA is the change made in terms of the donor’s “presumption of donation intent.” According to Verheijde, Rady, and McGregor (2007), a critical patient who is ‘at end-of-life support’ is presumed to have the intent of donating his/her organs unless he has a signed “refusal.” On the one hand, this is advantageous for the recipient (and the whole transplant list) for it adds to the current organs viable for transplantation.
