Louisiana has legalized marijuana at various levels, allowing it to be used for medical and recreational purposes. Due to the conflicting federal and state restrictions, there is now an interconnected set of state rules and guidelines governing the expanding market for marijuana-related products. Despite the lack of a federal legalization framework, the State of Louisiana permits cannabis use on a limited basis. On the national level, marijuana remains illegal in all forms. Cannabis is classified by the federal authorities as a Schedule I drug, implying it has an increased risk of abuse and provides no or limited medicinal benefits. Due to the conflict between federal and state laws, Louisianans can consume cannabis per state legislation while also breaching the law on the national level.
In a medical marijuana stakeholders’ meeting, there were several conflicts between federal cannabis law and Louisiana state laws I expect to rise. The federal law and the state-legal marijuana industry have been conflicting in legislation. The marijuana trade is growing with the potential to generate millions of dollars. Despite federal restrictions, Louisianans have access to legal marijuana, and the state's marketplaces generate billions of dollars annually. Further, uncertainties concerning criminal culpability in the state-legal marijuana market and challenges stemming from the conflict between federal and state cannabis legislation. The most pervasive issues are related to trade and capital, two sectors over which the federal government has complete control.
