Unions and labor organizers often devise strategies to exercise their democratic rights and push for bargaining powers with the employers. Hand billing has become one of the most common strategies used by labor organizers. Hand billing is a strategy where labor organizers or union members engage in a rigorous activity of passing out leaflets with information regarding the employers' purported unbecoming conduct that has sparked a dispute with the labor union, usually close but without company premises (Monaghan, 2017). As long as the handbillers operate outside the company premise without impeding entry or exit, they are protected by the First Amendment (Monaghan, 2017). Aggravated handbilling behavior may escalate to picketing. Interfering with other employees or customers who are not in dispute with the company in question is termed as third-party picketing. Considering the potential harm that picketing can have on a target business, it thus becomes necessary to devise a strategy to evade picketing. One of the traditional but most applicable strategies to avert secondary or third-party picketing is the reserved gate doctrine.
Often in a strike or picketing, some employees may not conform with the cause or the mode with which the strike or picketing has been implemented, termed as the neutral or secondary employees. The reserved gate doctrine seeks to implement the installation of a gate dedicated to neutral employees, leaving the rogue union members to picket only on the public entrance. Any attempt of the labor organizers or union members to picket in front of the reserved gate will impede the entrance of the neutral employee and thus renders the picketing process unlawful as per the previous National Labor Relations Board (NLRB) and court’s decisions (Zimmerman, 1961).
