Issue: The case Leonard v. Pepsico is fundamental. It involves Pepsico as the defendant and which is a beverage company that established a promotional campaign to push its products that would see not customers collect “Pepsi points but also eventually trade them at their discretion for merchandize (LexisNexis, 2020). In that regard, Pepsico through the promotional campaign highlighted some of the merchandize and products that were up for grabs and the specific points required to acquire them. There were several items that were put up in the commercial by Pepsico including a Harrier Jet that was estimated at 7 million points. Additionally, Pepsico accompanied the commercial with a catalog that clearly identified the promotional merchandize. Similarly, the company also provided an order form that indicated the items that were redeemable using the Pepsi points. It is essential to note that the Harrier Jet was neither listed on the catalog nor the order form. An overly ambitious customer and the plaintiff in Leonard saw the campaign and embarked on redeeming the jet which was approximated at 23 million dollars. Leonard examined the directions and instructions on the catalog which shared that the Harrier Jet was 7 million points and those consumers could access additional points for 10 cents but only after 15 Pepsi points are submitted with the order. It proved impossible for Leonard to raise the 7 million points required by buying Pepsico products. As such, he raised 700000 that he exchanged for the points and added the 15 Pepsi points as specified. Leonard then sent in his submission but was rejected with Pepsico sharing that it was only the items on the catalog and also the order form that were redeemable. Pepsico then went a step further to file a suit for declaratory judgement that the Harrier jet was not part of the campaign (LexisNexis, 2020).
