Review the following case scenario to inform the assignment that follows:
Charlie is a fifth grader who receives special education services for a learning disability. He is on grade level in math and two years below grade level in reading. He receives services in a resource setting for one hour each day. Charlie has no history of behavior problems.
Recently, Charlie was caught stealing software from the computer lab at his school. His teacher referred him to the assistant principal who issued a three-day suspension and required him to return the stolen materials.
The day of the incident, when Charlie returned to the classroom to gather his belongings, he confronted his teacher. He called her names, threatened to come back to school with a knife to “cut her,” and pretended to swing his fists toward her. Charlie’s teacher called the principal, who, in accordance with the student code of conduct at the school, issued an additional 10-day suspension for Charlie, bringing his total days of suspension to 13

Typically, the maximum suspension for a placement is usually 10 days. In this case, Charlie has been given a three day suspension by the deputy principal and an additional ten day suspension by the principal. This cumulatively takes his suspension days to thirteen; that is more than the ten day limit. Consequently, this means a change of placement. What happens immediately to him is that he is moved to an interim alternative educational setting (IAES). He will have to be therefore for the duration of determination of his case. Given that this case entails a change of placement and an issue about the student’s conduct, a manifestation determination has to be conducted.
The first people that should be contacted and informed by the LEA are his guardians or parents. They need to be informed in detail that Charlie has been comprehensively removed from the classroom; and that there might be some technicalities involved in his placement. It is then up to the LEA to advice the guardians accordingly on the best way forward, given the situation at hand (Bradley, 2007). As initially noted, this is a change of placement for Charlie, and therefore there might be certain procedures that have to be followed so as to formally effect the process.
It is worth noting that the disciplinary process and the actions to be taken in this direction are usually at the discretion of the LEA. The disciplinary actions permissible for the case of Charlie depend upon the result of a manifestation determination. A manifestation determination is usually a review procedure that is done to ascertain whether an individual is indeed disabled in any way.
