This week you are reading about the current and very spirited debate over birthright citizenship. The two assigned articles are testimony given to the House Subcommittee on Immigration and Border Security. Jon Feere believes that Congress should find a way to prevent the children of illegal immigrants and birth tourists from gaining automatic citizenship. Richard Cohen has a different view, arguing not only that Congress shouldn't legislate to ban birthright citizenship, but that it has no constitutional authority to do so. Which author do you agree with and why? Be sure and bring in examples from the readings to make your case.

"Both of the authors present good arguments on whether congress should do something about birthright citizenship. When it comes to the topic of birthright citizenship, I believe that it is a very reasonable Amendment. It provides citizenship for any person born on U.S. soil. It saves many from having to go through the citizenship process, and after all, America is a country built by immigrants. However, there are unforeseen situations that come with such a law. As Feere elaborated, With the birthright law in place, and many undocumented immigrants entering into the U.S., we are seeing a strong spike in birthright citizenship cases. I believe that this could eventually be problematic if not addressed, however I also do not believe that Congress has the constitutional authority to abolish it. The children that are born within U.S. territory deserve to be U.S. citizens and should not be forces to go through the grueling citizenship process. I instead believe that the best course of action would be to create more measures against illegal immigration. Therefore, I side with Cohen in keeping birthright citizenship, but definitely feel that the problem still needs to be addressed in several ways."

Although John Feere’s point is valid and shows how automatic birthright citizenship floods the United States of America (USA) with children from birth tourists and illegal immigrants, I oppose it vehemently. Every year, about 350,000-400,000 children are born by birth tourists or illegal immigrants in the USA (Feere, 2015). I side with Richard Cohen’s argument that Congress has no constitutional authority to ban birthright citizenship. The primary question I would ask Feere is: Why has the USA failed to implement effective policies to discourage illegal immigration, which has been a significant problem for decades? Birthright citizenship policy should remain intact, and children born in the USA should become citizens automatically. The actions that lead to the birth of these children are the ones that should be dealt with, such as eliminating illegal immigration.
