Introduction
Mandatory reporting of health data based on Federal and state laws have been around for decades in the United States. In most cases, this legislation has been passed in order to prevent cases (or suspected cases) of Child Abuse and Neglect, contagious diseases, and/or drug abuse. However, despite its seemingly ‘simple’ aim of averting an epidemic, preventing cases of child mistreatment, and/or mitigating drug abuse, the act itself has faced numerous conflicts with other legislation such as Privacy Protection. In order to further understand the implications of mandatory reporting, this article would focus on two recent events that show how necessary reporting health data is for use of healthcare providers as well as for the state interventions. Mainly, the author believes that through this mandatory reporting, state institutions could assess probable recurring problems within the society and quickly pass legislation against it.
Substance Abuse Crises and Mandatory Reporting
Just last year, the Department of Veterans Affairs (VA) passed a legislation that requires mandatory health reporting for healthcare providers who prescribes opioids to veteran soldiers. Originally, Opioids are prescribed in order to reduce pain and treat Post-Traumatic Stress Disorder (PTSD), which are persistent effects after long exposure on the battlefield. This was in line with the increasing number of drug abuse cases, that leads to higher death tolls within the country. In a recent news report in 2016, it was reported that about 64,000 Americans have died due to drug overdose and a significant percentage of this number are veteran soldiers. In most cases, the drugs causing them are mostly synthetic substances, such as Opioids and Heroin, which totals even more than the reported death toll for “guns, car crashes, and HIV/AIDS ever killed in one year in the US” (Lopez, 2017). To further this, a forecast from STAT (2017) showed that if not mitigated, this number could increase to almost “half a million individuals in America alone” by the next decade. These numbers, in turn, include not only drug users but also unborn children whose mothers are drug-users, leading to another emerging trend of increasing mortality rates due to “self-induced abortions”. In response to these, both the federal government and a number of states passed new legislation, including the (1) PDMPs (Prescription Drug Monitoring Programs) from the Department of Veteran Affairs as well as (2) local laws persecuting “self-induced abortions caused by Substance abuse of mothers” (Pollitt, ...
