I think that the protection provided by the Fourth Amendment leaves much room for interpretation of privacy and metadata. The Fourth Amendment protects individuals, their properties, and effects. If I were sitting in the court, I could have used the metadata from police to convict Plumber. The Fourth Amendment protects people and their properties. In the case of Plumber, police did not seize his phone for a search warrant. Instead, police used metadata from the telecommunication company to place Plumber at the scene of the crime. Metadata is a series of traces that one leaves behind when connected or when connected to a network. Seizure of metadata does not fall within the protection by the Fourth Amendment. Police did not take Plumber’s phone to search it without a warrant. Instead, they obtain metadata from the third party, the service provider in this case.
