Custody Negotiation Case: Mother's Environment Unfit for Child

Case Study Instructions:

Negotiation is a highly important personal and professional skill which presents itself with numerous challenges. Understanding how to successfully negotiate with a variety of persons is important for effective communication across a variety of contexts. Complete both part one and part two of this assignment.
Part One: Role Play
Directions: choose ONE of the scenarios from the attached "Negotiation Scenarios" document, or an alternative scenario approved by your instructor.
To successfully do your negotiation, follow the Seven Elements of Principled Negotiation found in the textbook and use those during your selected "Negotiation Scenario." For this assignment, you will serve as the initiating party of the negotiation. The objective is to gain a better understanding of the negotiation process and how each step functions.
You will need to solicit the help of one person. This person will take on the role of the adversarial party in your selected scenario.
One Volunteer
Please solicit the help of one volunteer, this can be a friend, family member, or classmate. This volunteer will help you role play the negotiation scenario. Share your selected scenario with the volunteer and inform them that there is no verbatim script, so they are encouraged to behave the way they feel the participant would in a real negotiation. Encourage your volunteer to approach this in a serious and realistic fashion when advocating for their assigned position. The provided scenarios should require about 20 minutes of your volunteers time in order to properly address the negotiation.
*To help orient your instructor, state the role you took and the goals you set out with in your essay. Additionally, include the name of your volunteer in your essay.
Part Two: Essay
After conducting the negotiation, write a 1,250-1,750-word paper that discusses your experience and cites at least four credible and authoritative references. In your paper, analyze and reflect on your experience negotiating using the Seven Principles of Negotiation. Consider the following prompts:
Were you able to focus on the relationship or did it become competitive?
What elements of communication were you able to attend to and which did you struggle the most with?
Did you remain on the interest or did it get personal?
What options did you generate for the outcome?
What were your solution criteria?
Did you achieve your desired outcome or use the BATNA?
Was the commitment fair and realistic? How so?
How might this negotiation have been different if it were real and not a role play?
This assignment uses a rubric. Please review the rubric prior to beginning the assignment to become familiar with the expectations for successful completion.

Introduction
I picked the custody negotiation scenario, which I shared with my friend Chris. In the scenario, Tim broke up with his girlfriend, Lauren, and separated for six months. They had two children who moved out of their home with their mother, Lauren, to live with Lauren's new boyfriend. The children occasionally visit their dad and share stories about their stay in the new home. According to his judgment, the children's environment with their mother and Justin is not favorable for their growth, and Tim wants to take them in.
On the other hand, Lauren believes that the Children are better off with her and are still adjusting to living with Justin. I played the role of a negotiator advocating for the children to live with their father while my friend Chris thought the children were more comfortable living with their mother. My goal was to ensure the children grow up in a positive environment with the proper love from their biological parents. In my opinion, Tim should stay with the children and occasionally visit Lauren. I intend to meet with the two parents to convince Lauren to give custody of the children to Tim.
Part one
I argued that the children are better off staying with their father. Six months of separation and Lauren is already living with another man does not show a good picture with the children because they will grow up believing that there is no wrong moving from one relationship to another. Lauren moved out of their house with the children and moved into another person's house, meaning she does not have enough resources to provide a comfortable life to the children. If that was not the case, Lauren should not have eloped with another man within that short time of separating from Tim.
Tim is a thoughtful person who does not rush into a relationship because he considers the possible effect on the people around him. It is the reason he has not brought another woman into their home because it is still early and has not ruled out the possibility of Lauren moving back to their house. Interest is a crucial factor in ensuring the children live in a better environment (Hak & Sanders, 2018). Tim and Lauren are interested in the two children, so both want to live with the children and provide them with the best care. However, the legitimacy and a fair deal are for the children to live with their biological father. A stepfather may not have the children's interest at heart, which means that their behavior may not best be a role model to the children. On the other hand, the biological father will provide a conducive environment for the children because they are his biological offspring and know their specific needs since they have lived together.
Parents always wish the best for their children and would sacrifice their happiness for their sake. Both Tim and Lauren have a strong relationship with their children, which is why the children are comfortable staying with both parents in turn. The issue is that the children are not comfortable with Justin because he behaves inappropriately towards them.
