Disability Discrimination and Retaliation Case
The U.S. Equal Employment Opportunity Commission (EEOC) filed a lawsuit against Raleigh, N.C., LLC on June 14, 2022. The case (Equal Employment Opportunity Commission v. NSN, LLC, Civil Action No.: 5:22-CV-00237) was filed in the U.S. District Court for the Eastern District of North Carolina (EEOC, 2022). The case was about a female employee who was summarily dismissed after complaining when some benefits provided by the law were withdrawn without a plausible reason. EEOC resorted to the lawsuit after attempts to reach a pre-litigation settlement through its voluntary conciliation process fell through. According to the case, the staffing company had violated federal law by discriminating against an employee based on her disability. Further, NSN, LLC was alleged to have retaliated against the said employee.
A Summary of What Happened
As stated in the lawsuit, the employee in question worked as a part-time administrator in the Raleigh testing center from 2006 until 2020, when she was dismissed. EEOC argues that the staffing company had granted her particular reasonable accommodations for a disability. The accommodations remained effective until the fall of 2019 when a change of guard in supervision happened. The new supervisor overturned some of the accommodations that had hitherto stood in place (EEOC, 2022). When the employee questioned this decision, the company retaliated by disciplining and reducing her working hours. To further aggravate the situation, the employee was fired six days after submitting a written complaint terming the actions taken against her as discriminatory. As a result, EEOC felt that the company had contravened the ADA and, therefore, filed a suit seeking monetary relief for the employee. The commission also sought injunctive relief against the company to take appropriate steps to prevent such unlawful conduct.
Law Involved and Summary of the Case
The law that the staffing company was alleged to have violated is the Americans with Disabilities Act (ADA). The Act, which became law in 1990, is a civil rights law that prohibits discrimination against individuals with disabilities (ADA National Network, 2017). The law's main objective is to ensure that people with disabilities are provided with the same rights and opportunities as everyone. It entails five key elements: employment, public services, public accommodation and services, telecommunications, and miscellaneous provisions.
One of the fundamental purposes of the Act is to help individuals with disabilities acquire the same employment opportunities and benefits that people without disabilities enjoy. In this regard, employers are required to provide reasonable accommodations to qualified applicants and employees (ADA National Network, 2017).
