The Classical theory proposes that a person commits a crime due to free will and to avoid crime, there should be an effective, public, prompt and proportional punishment dictated by the lawCITATION Jos02 \l 1033 (Joseph, Theresa, & Alan, 2002). Positivist school argues that people commit the crime, not as a result of free will but rather it is a trait that they are born with. It also identifies two types of criminals; the insane criminal and criminaloid. Insane criminals were not born criminals even though they have characteristics of a criminal. Criminaloid have no characteristics of a criminal but became criminals later in life.
An example of the positivist school of criminology is the Italian School of Criminology that was founded by the “father of criminology” Cesare Lombroso.
