The case is about the violation of the Equal Protection Clauses of the 14th Amendment because Trinity’s application was denied and was not allowed to use money from public treasury to purchase recycled tires to restore the condition of their playground. Their freedom of religion and speech was taken away from them by denying their application.
Pauley’s motion was granted by the district court to dismiss for the purpose of failure to state a claim. Therefore, Trinity motioned for reconsideration and its complaint be amended to cover allegations because other religious organizations were successful in their application. The motions were denied by the district court and the 8th Circuit under Court of Appeals gave affirmation to the dismissal and the motion denial to reconsider and complaint amendment.
The supreme court denied the petition because the case is unlike other pleas heard by the lower and this Court. In majority of the cases where Trinity Lutheran depends on to search for conflict or confusion, the flow of public money is being dictated by private groups or parties. It is not the 1st time that the court to face questions about their decision on the flow of public records for school funding where the choice is decided upon by parents or students.
