If I were the Supreme Court Justice in the Green v. County School Board of New Kent County (1968) case, I would rule the “freedom-of-choice plan” unconstitutional. There are only two choices to choose from by the students. In most cases, a black student would basically choose a black school similar to a white student choosing a formerly white school. The plan was still based on school selection by racial basis. Such acts would not reduce discriminate minimizing the constitutional mandate of desegregation.
