The utilitarian theory of ethics is focused on differentiating between wrong and right based on the outcomes. Besides, based on this theory, the punishment of offenders helped in preventing wrongdoing in the future. The law is interpreted in a way that ensures the maximum benefits to the society. It is critical to note that crimes tend to facilitate unhappiness in the community; the utilitarian theory aims to reduce crime to increase happiness in society. Therefore, the level of punishment should reflect the extent of unhappiness caused to society members (Murtagh, 2020). Based on this view, individuals with an extensive criminal record should be punished more because they have caused more damage to the community and are likely to cause more harm in the future.
Therefore, the first priority should be given to a person's criminal record because it helps provide a historical preview of an individual. By looking at such a criminal record, it is easy to conclude that an individual is a repeat offender and not a first time one. On the other side, a high priority is given to situations where the actual offense caused high levels of unhappiness and sadness to community members. If the actual offense affects many members in society, then the punishment should be more severe than when the punishment only affects a few individuals.
