The Privacy Act of 1974 is a federal law established to govern the collection, use, storage, and dissemination of individuals’ personally identifiable information (PII). Before 2007, the Act protected only US citizens, but an amendment by the Department of Homeland Security extended the protection to non-citizens as well. The Department of Homeland Security is at the forefront of data protection in the US and has taken numerous steps to ensure this is achieved. The DHS has made considerable efforts to ensure that the Fair Information Practice Principles (FIPPs) comply with the Privacy Act. Through the Privacy Office, the DHS secondary mission is to maintain individuals’ privacy and dignity while undertaking its core objective of securing the country (US Department of Homeland Security). This paper breaks down the Fair Information Practice Principles and analyses the steps that the DHS has taken to comply with these principles.
Transparency
The Privacy Act requires that individuals be duly informed of how their personal information is collected, maintained, and used. In other words, it is against federal law for a body to ‘secretly’ collect information regarding an individual without their consent or knowledge (Exec. Order No. 13636, 2013). This enables individuals to track their data and be in control of their private information. The DHS is duly committed to enabling the transparent collection, use and retention of data regarding both US and non-US citizens.
