Can Juvenile Offenders Be Effectively Punished for Their Crimes?
The Crime and criminology sector has always been faced with some issues, and one of the main challenges is juvenile delinquency. In the bigger picture, there has been a dilemma in the society as a whole on juvenile offenders and the idea of providing an effective punishment for offenses that are of equal weight to those by committed by adults. The punishment that juvenile offenders should be given has been a matter of discussion over the years with people calling for their trials to be conducted as those of the adult offenders. Crime continues to be a critical issue in the society, and the level of crimes has worsened too. The culprits can either be young, old or both. The extents of the crimes cannot be pinned down to the age of the perpetrators. However, we should also consider the factor that the juvenile delinquents are still at a crucial developmental stage of their lives. They are also under the care of their parents and many factors undermine their sensible response to issues. This paper therefore explains that juvenile offenders should not be put to the same trail system as the adults.
The juvenile court system has changed gradually over the years with the understanding that the offenders are minors, at a critical stage in their lives. This stage is marked by a change in appearance, thinking, experience and perception of things. Their minds are experiencing specific changes, their bodies too, and they are very critical of their appearance too. According to Stimson (2015), this stage of development is characterized by erratic thoughts and acts and increased impulsiveness brought about by immaturity and irresponsibility of their ages. Violent crime is as brutal as it comes and can have some serious consequences on the victims. They might end up committing such crimes out of unavoidable influences.
On the contrary, taking these juvenile to court in a similar manner to adults might be an injustice to them. In most cases, the most of the juvenile offenders who have faced trials especially those are of the same weight to the adults like executions were just doomed from birth. They faced trials without considering the situation’s remorse when they committed the crimes. They could have been facing troublesome situations growing up like domestic violence and abuse (Umbach, Berryessa, & Raine, 2015). Failure to consider this fact affects the society’s morality when we decide to send our children to rot in the prisons for committing crimes under severe pressure. The solution to this challenge is having a profound insight in such cases and trying to correct our social systems to improve responsive responsibility and maturity among our teens.
Secondly, it would be unfair to sentence juvenile offenders as adults, since it would be an open display of double standards. Under almost all the legal codes, we consider a minor as an individual who has not yet attained a certain age that is allowed for them to do some things considered critical. We have denied them some privileges we deem unsuitable for their ages like drinking, driving, and voting...
