In United States v. Cruikshank, the Supreme Court threw out conviction of Mr. Cruikshank and other whites involved in the Colfax Massacre that took place following the controversial 1872 Louisiana Gubernatorial race. The massacre involved the death of three whites and 150 African Americans. The ruling in the case set a precedence in the enforcement of the 14th amendment who purpose was to provide equal protection for American Citizens.
In the ruling, Judge Waite sought to limit the rights of national citizenship by establishing a distinction between state and national citizenship (United States v. Cruikshank, 1875).
