In regard to US law, every student has the right to access education. Therefore, if that right is violated through a suspension, the students deserve to have a due process. In some cases, the due process requirements for a short-term suspension vary from those of a long-term suspension depending on the institution. In addition, the Goss V. Lopez court case was ruled out that students in public schools deserve notice and a hearing before being suspended. This was based on the Fourteenth Amendment due process clause. Most institutions have followed this clause to ensure that they do not violate the students' rights to learning. As well, the institutions should ensure that they have written rules that the students ought to follow. Hence, in the case of a violation of such rules, then the students are subjected to the due process before being suspended. The Houston Independent School District is not different from other institutions since they have a due process to follow when suspending students. Their due process is in accordance with the Goss V. Lopez case since they give the students notice and hearing before the suspension.
