Introduction
This case, Korematsu vs. the United States was finalized on 18 Dec 1944 by the Supreme Court, which upheld the conviction of Fred Komatsu. However, in 1983, a pro-bono legal team re-opened the case in a federal district court with a new evidence. At the federal court, the judge cleared Korematsu name but the U.S Supreme Court decision still stands. This essay seeks to analyze this case by explaining the history and facts concerning it.
History and facts about the case
In 1942, immediately after the Pearl Harbor attack by Japan, the president Roosevelt issued executive order 9066, that excluded people from certain areas. On the 3rd of May, exclusion number 23 was issued in which Komatsu and his family was to be relocated. His family complied, but Komatsu failed to comply. He had a plastic surgery to alter his appearance, changed his name to Clyde Sarah and claimed to be a Spanish descent, (Chemerinsky, 2011).
However, he was arrested on May 30th and sentenced for five years because he violated a military order. After appealing his case, the U.S Supreme Court heard it on October 11th. However, the Supreme Court upheld his conviction through a 6-3 majority decision.
