South Carolina’s Crimes and Offenses laws define murder as the killing of any person with malice aforethought (Findlaw, n.d). The penalty for murder is death or minimum imprisonment for thirty years. The state’s law states that a person found guilty of murder must be punishable by death or by a mandatory minimum imprisonment term for thirty years to life (Findlaw, n.d). Generally, an assault is an attempt or threat to cause bodily harm to another person, whereas battery is the unwanted touching of another person in a harmful or offensive way. The difference between assault and battery, according to the South Carolina statute, is that assault relates to the threat of violence, while battery is the actual act of hurting someone.
