The U.S. Constitution provides various rights that are to be enjoyed by the subjects and various limitations that are to be adhered to. Maryland's state constitution, which is reserved for state governments, provides various rights that are to be enjoyed by citizens living in Maryland. To begin with, a state section that is similar in the U.S. and Maryland state constitutions is freedom of speech. According to the first Amendment to the U.S. Constitution, no laws shall be made to prohibit freedom of speech (Lakier, 2020). Through this, individuals have a right to peaceful assembly and even a right to publish. However, there are various limitations, including the law not recognizing child pornography, obscenity, or incitement to illegal conduct as part of freedom of speech. Under Article 40, Maryland's constitution grants its people freedom of speech and press (Donaldson, 2021). According to Article 40, freedom of the press must be protected indefinitely. Every citizen of the State of Maryland has the right to write and even publish their opinions on issues, but they are also held accountable if those rights are abused.
Another Maryland state section that aligns with the U.S. Bill of Rights is freedom of religion. Veneziano (2019) depicts that the First Amendment states that the government cannot deprive individuals in the U.S. of their right to religion. Thus, individuals have the right to manifest their religion, teach it, observe it, and even change it. However, while there is a compelling interest in taking such measures to protect the common good, various limitations are imposed. Similarly, under the Maryland Toleration Act of 1649, citizens' freedom of religion is protected. According to the first Amendment of the Maryland Constitution, every citizen of this state has the right to exercise their religion freely. Hence every citizen is equally entitled to protection, despite their choice of religious liberty. Furthermore, no citizen in this state is to be molested due to their religious profession.
