Cybercrime investigators and prosecutors face tremendous challenges in apprehending cybercriminals. Prosecutors do not always understand digital evidence and how to apply it in court. The lack of adequate expertise is a hurdle to effective cybercrime investigation and policing. Investigating crimes requires high-level technical skills and knowledge. That said, there exists scarce evidence that law enforcement officers have the necessary training and qualifications to execute their mandate. Training prosecutors on comprehending digital evidence and leveraging it in courts is necessary (Arifi & Arifi, 2020). This implies that the cost of training detectives in the employment of digital evidence should be incorporated into the costs incurred to train law enforcement officers to gather and preserve digital evidence.
Countries are enacting policies guiding the handling of cyber-crimes, which makes it difficult for investigators and prosecutors to apprehend suspects due to foreign legal frameworks’ extradition pacts. However, it must be noted that Ukraine, Russia, China, and the United States lack extradition pacts, which makes it hard to prosecute (McKoy, 2021). The solution here is to harmonize federal regulations with international conventions to improve investigative modalities and augment global cooperation in addressing the cyber-crime menace.
