The Effects of Mass Media Publicity
Pretrial publicity has a significant effect on the outcome of cases and one of the tools at judges’ disposal to minimize the impact is voir dire. Voir dire is the process of questioning potential jurors to exclude from the jury box those that have already made their mind about the case or those having strong biases towards one party (Calvert et al., 2018). This tool was implemented in the case of the United States v. Tsarnaev. This much-publicized case pitted the state against Tsarnaev and his brother for detonating explosive devices causing the 2013 Boston Marathon Bombing (Abrams & Calkins, 2021).
The application of voir dire did not have a significant impact on the case primarily because of the nature of the crime and the high publicity it received but it allowed for fairness to prevail.
