Changes on Crime of burglary and its severe penalties
The understanding of burglary has substantially evolved greatly. Some scholars even argue that burglary doesn’t to be classified as a separate criminal offence anymore. Burglary is a crime that has substantially evolved. However, what has remained consistent revolves around its seriousness of breaking into a building, or part thereof, with ensuing damage that holds the potential to cause harm to people and property. In Anglo-Saxon times, Burglary offence was referred to as husbryce (Goebel,2016). Husbryce meant ‘house breach.
Since then, the understanding and definition of this crime was a change to inched possible injuries and harms to other parties in the cause of such invasion. However, its definition was geared more towards a person having caused injury to another in the process of an armed raid on a town. In mid-15th Century, breaking into a building was not considered a separate offence, but it could have been interpreted to mean felony, which was remedied by a death sentence. Laws have continued to merge in response to defining and dealing with burglary. In 2008, more than 20 states enacted laws called “castle doctrine” laws to empower homeowner with the legal right to use force when defending himself or herself and the family against an intruder (Ren, Zhang & Zhao, J2015).
