The Supreme Court is one of the most favored judicial institutions by the public because of several factors in the way it upholds the law and the vetting process in appointing the judges. Its position as the highest court necessitates impartiality for the protection of the constitution and the trust of the nation. It is a government institution built on the basement of unbiased and non-partisan judgment and bases its decisions on the general good and the protection of individual rights. This can be shown through several cases and instances that weigh the objectivity of the court, indicating the extent of the institution’s impartiality.
One of the indications of the solid foundation of the Supreme Court is the level of vetting of the judges that serve as it has the least number of approvals compared to appeals and district courts. The selection of the judges is usually clouded by political alienation, which narrows to individual cases as determinants of objectivity of the court. In an interview, Supreme Court Justice Stevens described the court as rendering equal justice under the law regardless of the person’s status. The court has proved its fairness on individual rights through several decisions that even disagreed with the state. The Guantanamo bay prisoners’ case was one of the prominent cases that the Supreme Court exerted its impartiality through protecting their civil rights despite the government’s decision to withhold them.
