The constitutional-making process in the newly born United States of America was very intricate, involving the leaders of the time in business and politics, borrowing its legal framework from other precedent works, and its philosophical influences from various philosophers in the past. This paper will use three prompts to show some important documents, philosophers, and events that influenced the US constitution.
Section 1: Important Documents
There were several documents that had a major influence on the making of the United States Constitution. Two such documents are the Magna Carta and the Articles of Confederation. The Magna Carta provided the groundwork for civil liberties not just in the United States, but across the world. In the US, the Magna Carta influenced civil liberties in different ways throughout the country’s history (Hazeltine, 1917). It was a document established by King John in 1215 and stipulated that the king was ‘under the rule of the law’ and that the citizens had various liberties protected under this charter. On the other hand, the Articles of Confederation was the first agreement that outlined the frame of the government to be adhered to by the thirteen states that established the United States. These articles among other issues recognized the need for states to maintain their sovereignty within the federation (Lutz, 1990). The tenets envisioned within these two documents played a key role in the formation of the US constitution, both in terms of recognizing how every individual in the country was subject to the rule of the law, and in ensuring the representation of each state under the federation without consideration for its size or population in the case of the Articles of Confederation (Lutz, 1990). These tenets still hold true today since civil liberties still form the basis of the upholding US constitution, while bicameralism, as envisioned in the Articles of Confederation, is still upheld in the constitution.
Section 2: Philosophers and Philosophies
