Impact of HITECH and HIPPA Regulations on Health Care Systems
Introduction
In 1996, HIPPA established new standards for the transmissibility, confidentiality, and security of healthcare information. These new standards involved privacy, administrative simplification, and security. Taken together, these standards significantly affect the daily operations of the nation’s hospitals and impact almost every department of every entity that pays for, or provides health care (AHA, 2017). HITECH supplements HIPAA by promoting the adoption and meaningful use of health information technology (Dyer, 2010). Implementations and regulations facilitated by HITECH and HIPAA have significantly affected certain entities involved, such as organizational standards, and hardware and software vendors.
Impact of HIPAA and HITECH Regulations on Health Care Systems
HITECH and HIPAA regulations facilitate the creation of health care systems that ensure high-level medical privacy. When it comes to handling medical systems, HITECH ensures that there is accountability. This accountability is vital, especially when handling medical systems. HITECH also broadens the scope of security and privacy under HIPAA. HITECH uses federal laws as a basis upon which it outlines its requirements on medical privacy. HITECH considers state laws as strict, and as such, it cannot afford to supersede. Contrastingly, these state laws make it feasible for attorneys to act upon HIPAA to inculpate criminal or civil cases that may be committed by staff members or business partners of covered entities. HITECH and HIPAA regulations have resulted in the development of breach notification software systems that monitor the individual or individuals accessing health information that is protected under state or federal laws.
Modification, Implementation, and Ongoing use of Software Systems
Periodically conducting audits of patient data, kept centrally in an online location, by using software systems ensures that the information coincides with the established regulations and rules. This is facilitated by using the HITECH Act, which permits and compels the Health and Human Services Department to conduct these audits. Actions such as audits ensure that patient data is continuously managed without traces of fraud or unauthorized access. Cases of fraud or unauthorized access may result in willful neglect, which can cause patient data loss (HIPAA Journal, 2013). When it comes to maintaining patient data, HITECH supplement HIPAA as it ensures that it adheres to state and federal law regulations.
