Interestingly, the risks associated with the “curbside consultations” depend on the state within which they are practiced as opposed to the legal requirements and standards related to it. Nonetheless, it is true that depending on the state, such consultations may be considered to act as a resource depending on the intention and area of application. Thus, it creates the question of what factors would cause liabilities after consultations? It means that consideration on the use and the ability to consult the guide will be used to determine liability respectively. Most of the time, the consultation of physicians is considered the inability of the one consulting to decide on their won. In this case, it is considered a form of guidance. There is the element of reliability and the need to make use of the information for subsequent treatment offered. There is need for liability especially when documented hence the need to offer guidance using the standard of care.
