The case of Mr. Smith, the American consultant managing one of the newer projects of the company requires the application of the laws of human resource management to decide whether to terminate the contract or not. I would approach Mr. Smith directly and indirectly about his performance in the last three months of his contract. While it may benefit the company to terminate the new consultant 8 months earlier before his official contract of 20 months is finished, there are legal concerns to address. For instance, in this case, Mr. Smith has not violated the terms of the contract. Gathering facts from others might not be an effective way of understanding his underperformance and it would not be professional to cite his overspending if the company has provided such benefits.
