The above case study presents the issue of malpractice in nursing. George (2015) defines malpractice as negligence, misconduct or a breach of duty which often results to serious injury on the side of the patient CITATION Geo15 \l 1033 (George, 2015). In this case study, Ms. Florscheim was the one assigned to handle the patient Mr. Ad. Mr. Ad started experiencing nauseas and difficulties in breathing. His wife went ahead to ring the bell so that the nurse would come and help him. Later in the evening someone responded and gave Mr. Ad a treatment for the nausea but it worsened. At this point, we can also see one legal issue arising. The person who gave Mr. Ad the treatment for the nausea was not the one supposed to carry it out. Since Ms. Florscheim was not around, she had delegated her duties to someone else. After the situation deteriorated, Ms. Florscheim called the nurse for some time and there was no any response. Finally, a code is called but Mr. Ad does not survive the code as he dies. This is an indication of negligence of duty which has caused damage in the form of death. Mrs. Ad has every right to sue the hospital for causing the death of her husband. Things in the entire case started going wrong when the responsible nurse did not respond to the first bell rung by the wife. Instead, she delegated duties to someone else who does not understand the health condition of the patient and they went ahead and administered their own medication. We are not so sure whether they administered the right medication on Mr. Ad since after the medication, his condition deteriorates.
In the above legal issue, there are four conditions which need to me met before the hospital and the nurse is are judged. Did the nurse have a duty to the patient, was there a breach of this duty? Did it lead it lead to patient injury or damage? Is there a causal relationship between the breach of duty and the injury of the patient. In the above case study all these conditions appear to be fulfilled. The nurse Ms. Florscheim had a duty of handling the patient Mr. Ad. Despite having the role on the patient, the nurse failed to carry out an assessment on the lungs and respiratory situation of the patient.
