The case covers the certification procedure for workers in a negotiating unit at Waldun Forest Products Ltd. The union was in charge of this certification application and was required to take the viewpoints of family members, casuals, and management into account. The union successfully implemented its recommendations, which were quickly followed by a claim of unfair treatment from the employee. As a result, the voting box was locked until several contentious problems had been resolved by the Labour Relations Board.
Usually, the Union and Employer each had a general stance on the certification procedure. For example, the Union Concerning Family Members stated that Curtis and Colin Walker's inclusion in the bargaining unit would have resulted in conflict given their strong relationship with their father (owner). Additionally, it contends that because they are members of the management team, Daum, Povlsen, and McBride had to be disqualified. It claims that the remaining challenged employees were part-time casual workers who were required to be eliminated since they did not share a common interest with the regular full-time employees. On the other hand, an employer's general stance toward the two Walker brothers contended that the fact that they are the children of the business's primary owner, Wynn Walker, does not constitute a good enough justification to bar them from employment. The independence in decision-making and many other areas that these two men exhibit help to explain this.
