Intellectual Property Rights (IPRs) has become a very fancy and frequently used term after the birth of the iPhone generation, although it goes back to the 19th century. In the 21st century, when IPRs laws are well in place in western countries, companies can protect various aspects of their business with the help of relevant IPR laws. Amongst the common types of intellectual property rights are trademarks, copyrights, patents, trade secrets, and database.
In the coming section, we are going to discuss the role of IPRs laws in the economic development of China and how the current system can be improved to maintain that growth level.
IPRs in China and the Economic Growth
Since the late 1970s, intellectual property rights have been playing a significant role in China’s economic growth and development process. The IPR system has undergone through vital improvements on the legal front due to which China has become a member of the Paris Convention for the Protection of Industry Property, Berne Convention for the Protection of Literary and Artistic Works, World Intellectual Property Organization and few more (Holbrook). This rapid growth has been witnessed in the last thirty years or so.
The signing of different treaties and becoming a member of international organizations to tackle the abuse of intellectual property has streamlined many processes in China. This has helped the country not only enforce international laws but to form new laws locally. In the absence of actual IPRs code, the intellectual property rights are used based on the compilation supplemented with the aid of various legal measures and interpretations.
The local governmental body has enforced the Anti-Unfair Competition Law with others that Patent Law, Copyright Law and Trademark Law should be included (Campi & Dueeas, 2017). The state councils have a choice to devise and implement locally formed laws to prosecute and protect the intellectual property, or they can go with what is already in place.
Last three decades have seen phenomenal growth in China’s economy. According to some survey, a nine-fold growth was recorded after the country opened its international doors for foreign investment (Klein, 2015). Despite the challenges like widespread low skilled labor industries, China has seen average GDP growth of 10 percent in the last two decades. The national government is trying to keep up with the trade policies after facing tremendous pressure due to international trading. The revised policies will enable the country to unlock many other doors for economic development and growth purposes.
It is not a secret that China’s economy has been booming in recent years and it is not unsafe to say that the reforms in trade and IPRs policies are paying off well. More future IPRs policies-making talks are always underway to align the ongoing progress with relevant laws to attain and maintain the longer sustainability.
The above picture illustrates how in ten years (1995-2015) China from being at the bottom of the curve reached to the top after leaving its competitor countries behind (Kim et al. 2012).
