Raping is a crime, and whoever engages in such a heinous and inhumane act should be punished or sentenced accordingly. In 2016, Brock Turner was convicted for sexually assaulting an unconscious and intoxicated woman at a fraternity party behind a dumpster. Turner was found guilty of sexual assault and sentenced to six months in jail by Judge Aaron Persky from Santa Clara County Superior Court. In my opinion, the jail sentence was unfair.
Turner’s lawyers used the ambiguous definition of rape to get an appeal. In particular, rape culture involves the set of beliefs and values that offer a conducive environment for rape (Boswell & Spade, 1996). Although the term does not refer to the specific settings that cause rape, it is crucial to show how Judge Persky gave such a short jail sentence to Turner for sexual assault. Turner should have been convicted for sexually assaulting an unconscious and intoxicated woman and attempting to rape the lady (Elias, 2018). If the two graduate students did not confront him, he should not have stopped trying to rape the unconscious victim.
In reality, it was unfair for Turner to defend himself by saying that his actions were fueled by alcohol. I think he was trying to justify attempted rape for being under the influence of drugs. Judge Persky should not have said that he considered Turner’s education and athletic career when making his judgment (Stack, 2016). If that was the case, he should also have considered the trauma that the victim would have to live with if Turner had raped her and was not ...
