1. Specify the key requirements for police officers in determining the lawfulness of the use of force in making an arrest and what is meant by "reasonableness?
When arresting a suspect, the police officers are guided by the measures that ensure they don't intimidate and infringe the rights of the arrestees as anchored in the Fourth Amendment of the United States of America. Although these guidelines differ from police departments, while determining a lawfulness arrest, the police officers must show requirements such as personally tangible evidence indicating a witnessed suspect doing the crime evidence, has warrant arrest showing orders from judicial officer indicating the person is accused of having committed crime (Harmon, 2016). The police officers are liable for showing probable cause to prove that the suspected person has committed a crime. The term reasonableness in law perspectives refers to the inability of the court to prove a suspected criminal is guilty of committing alligated offenses that are against the law (Harmon, 2016).
2. Evaluate how free speech rights clash with the rights of others and the need for public order today.
The freedom of speech as stipulated in the First Amendment of the US Constitution when being exercises by American citizens leads to violation of other rights. The speaking of provoking and incitement words that may cause conflicts in the society, thus denying the citizens from enjoying the right of peace. The freedom of speech has resulted in compromising in court proceedings during court ruling, especially in petitions pertaining to violation of this freedom because there is no limit on the type of speech that protected and words that can be seen as incitements. Public order is very important today, especially in the incumbent government, because it ensures law and order in the society through law enforcement and adherence to state rule and regulations, prevent criminal activities, and keeping the equilibrium between the rulers and their subjects (de Lint, 2016).
