This essay focuses on copyright and music. You'll be presented with a hypothetical scenario and must determine what, if any, legal action is necessary to resolve the dispute, justifying your response with case law we've studied this semester. Those cases are as follows:
The year is 1906. You are a lawyer who represents a number of Tin Pan Alley sheet music publishers. One of those publishers—F.A. Mills—approaches you for legal advice. While flipping through the pages of The Ladies’ Home Journal, Mills noticed that the Aeolian Company was advertising a new piano roll recording of George M. Cohan’s “Give My Regards to Broadway,” a song published by his firm. Mills is outraged that he did not receive any financial compensation from Aeolian, and wants to pursue legal action. Note the following:
F.A. Mills (the publisher) obtained a copyright on “Give My Regards to Broadway” in 1904.
The Aeolian Company did not contact F.A. Mills or George M. Cohan to seek permission to reproduce the song on a piano roll.
Write a letter to your client in which you explain what, if any, legal action you might take, and justify your answer.
