1 What is the purpose of probation? What are the responsibilities of the probation officer?
There are purposes people are placed under probation rather than taking them to prisons. One of them is the assumption that the offender is not dangerous to society; instead, he/she is one who has made a mistake and has the potential to reform. The decision of not taking them to prison is to prevent them from interacting with hardened criminals who may negatively impact on their behaviors (Chapter 12 pg.472). It is also to prevent them from gaining the label "ex-con," which may affect their successful integration into society (Chapter 12 pg. 472). Besides, probation helps to prevent over-crowding in jails as only 'dangerous to society" offenders are placed in jails/prisons.
2 What are the rights of the probationer? Is probation a privilege or a right?
Probation offers have five primary roles in the U.S. criminal justice system. One of their leading roles is to investigate the past activities of offenders to help determine whether or not they deserve probation (Chapter 12, pg. 476). Additionally, probation may conduct interviews on stakeholders involved in a case to help find a solution without proceeding to court action (Chapter 12 477). Furthermore, probation officers are involved in diagnosing offenders who have committed crimes due to problems such as mental illness, serious addiction problems, adverse psychological distress, and depression, among others (Chapter 12 pg. 477). More so, the officers are involved in assessing whether offenders who receive probation are a risk to other people/society.
