Introduction
Defects present the main causes of contract disputes and construction litigation. Dealing with construction defects needs knowledge of construction laws, and building construction and technology. Construction defects may include issues with aesthetic components like poorly painted walls, deteriorating doors and windows, and framing and construction faults that may affect the structural integrity of the building.
The contracting company Third Lens Corporation (TL) recognizes four categories of defects that will warrant repair by the contractor 6 to 12 months after the completion of the project. The defects categories include:
* Workmanship deficiencies
* Material deficiencies
* Design deficiencies
* Specification deficiencies
Defects Liability under the Contract
Condition 1-If a contractor uses poor workmanship, substandard materials, an alternate design and does not deliver the building as specified in the construction plans, and the building falls before the elapse of the liability period, he or she shall repair the damages at his own expense.
Condition 2- The contractor is obligated to complete the construction of the building in a workmanlike manner as outlined in the contract document. In case of defects during construction, the contractor has to repair them at no added cost to the client. The contractor will also have to meet the damages caused by the delay of the project.
The goods, materials, and workmanship have to be of the standards described in the contract and reasonably satisfy the architect. This means that the contractor has to undertake the project with care, skills, as per the intended design and utilize quality materials.
