The OSHA commission issues the citation and penalties as an indication of some violations having taken place by the employer regarding the safety and wellbeing of the employee. In this case, issuance of the penalties and citation has been done according to OSHA provisions; the issuance was done after OSHA had inspection on the premises where employees work. The inspection showed that the employer had made various violations, and a serious citation was highlighted. The employer or employee should thus take several steps in response to the citations and penalties that have been imposed.
Steps to Take
Once the employer has received the notification of the citations and penalties imposed and they have been satisfied with the fines, the first step to take would be making payments to OSHA in the amounts stated in the citations and penalties. The payments have to be made within the time frame that OSHA has stipulated, lest the citations and penalties attract further fines. The payments made by the employer depend on the number of violations highlighted by OSHA and the penalties imposed (Chojnacki, Deutsch, Perez-Johnson, Amin, Darling, & Lefkowitz, 2016). Further, the employer should place the citations imposed by OSHA near the working spaces where the OSHA inspection officers identified potential hazards to employees. This should be repeated for three consecutive working days, excluding weekends and holidays, or until the identified hazard has been addressed.
If the employer has not been satisfied by the citations and penalties imposed by OSHA, they should make a formal appeal addressed to the OSHA commission, raising their complaints on why they feel the citations and penalties imposed are unfair. The complaint formally sent to the OSHA commission with all complaints stipulated, should be done within 15 days of receiving the OSHA notification.
Options Available to the Employee
The employee affected by the hazard highlighted during the inspection can file a complaint to express their dissatisfaction with how the inspection process was conducted. Further, the employee can also attend the informal conference that has been requested by the employer so that they can contest the citations and penalties imposed.
