Racism in the United States has long been a problem. There is always the never-ending battle between White and Black. Everyone is already aware of the outcome of this division: Whites are always superior, receiving opportunities and privileges, whereas Blacks are inferior and do not receive the same opportunities and privileges as Whites. However, it is unfortunate that racial disparities occur in schools, which were supposed to be a haven for children to learn proper values. The US Department of Education assigns students to specific schools to achieve racial balance, but it appears that the goal is not met. As a result, not all students, particularly those of color, are afforded equal protection and rights.
The Equal Protection Clause of the Fourteenth Amendment requires states to practice equal protection. One method of providing equal protection is to assign students to specific schools to maintain racial balance. Public schools typically ask parents or guardians to identify the race and ethnicity of their children upon enrollment. 44% of all schools ask parents to select one of the five standard federal categories (National Center for Educational Statistics, 1996). To ensure that there is racial balance, schools segregated students (Fish, 2019). They established schools that are inclusive of Whites, inclusive of Blacks, and other races. They segregated the students with the main goal of providing equal protection. However, this incident has led to problems, including legal proceedings.
There are legal cases that challenge the classification of gender in schools because the goal of providing equality in education is not met. Herman Sweatt’s legal case is the first. He applied to the University of Texas Law School, which is all-white. He was rejected because of his race. He complained, and the Court decided to open an all-black school in Texas with a capacity of only ten students.
