Legal issues
More than ten decades ago, the Supreme Court in Brown v. Board of Education indicated that education remains a critical function of state and local governments since it is the foundation of good citizenship. The court recognized racially diverse schools as instrumental in offering an education that promotes cross-racial understanding, hence facilitating the breakdown of the walls of racial divisions (Goldstein, 2004). Subsequently, the Supreme Court has relied on the Brown v. Board of Education to make decisions to enhance racial diversity in schools. In 1971, the Charlotte-Mecklenburg Board of Education court held unanimously busing measures that sought to speed the process of racial integration in learning institutions. The court recognized that school officials had powers to ensure integrated student bodies. In 1978, the Supreme Court in Regents of the University of California v. Bakke struck down the admission policy of the university but at the same time held some consideration of race as a factor in the process.
