Environmental law is an intricate mix of health concerns, regulations, and local, federal, and state laws. It is also a dynamic area of the law, with changes occurring rapidly, making it difficult to make choices. There are five fundamental policy instruments at play, classified as the 5 Ps of Policy Design.
Prescriptive regulation is a form of policy design instrument that precepts what parties can do and what they cannot do (Ruhl & Salzman, 2020). For instance, in the context of a pandemic, the US government may limit or restrict movements. It helps in mandating uniform compliance across all states and preventing racism and an array of other benefits.
Property rights define the privatization of resources, allowing individuals to do as they wish with their properties.
