Role Of Executive Orders in Expanding the Powers of The Presidency
The US constitution sets article II which deals with the executive branch and describes the roles of the president as well as the method of electing a president, terms, and qualifications. It also deals with succession and impeachment procedures. These specific express roles of the president outlined in Article II of the constitution are known as formal powers. They include commanding the military, appointing supreme court justices and cabinet heads, and vetoing legislation.
However, the powers of the president are not limited to only those expressly granted in Article II of the constitution. The presidential authority has expanded over the years as presidents claim other powers, known as informal powers. Informal powers are those powers claimed by a president to help execute a law, and they include: negotiating executive agreements, claiming privilege, and issuing executive orders (Fisher, 2013). This paper details how executive orders have contributed to the expansion of the powers of the presidency
