The issue presented here is whether or not the decision made by the district court was a mistake in regards to its final judgment favoring Google over the copyright infringement claims by Oracle (Hardy & Perlroth, 2012).
With the application of Ninth Circuit law, it has been found out by the United States Court of Appeals for the Federal Circuit that the expression of a process or method is protected by copyright. As set down in Lotus, the hard and fast rule, such that elements are never copyrightable if it performs a function, is in conflict with the endorsement of the abstraction-filtration-comparison analysis by the United States Court of Appeals for the Ninth Circuit. An element can still comprise an expression that is protected by the copyright despite being depicted as a method of operation (Menell, 2016).
In the United States District Court for the Northern District of California, Oracle filed a suit against Google Inc. ("Google") due to the infringement of the operating system of Google's Android mobile with patents and copyrights of Oracle. There was no patent infringement found by the jury. Yet, it discovered that the copyrights of Oracle were infringed in 37 Java packages of Google along with ”range check”, a specific routine of the computer. However, the verdict remained as non-infringement as to eight decompiled security files. The defense of fair use of Google was deadlocked by the jury. When the jury has decided on the verdict, the motion of Oracle for judgment as a matter of law (JMOL) was rejected by the district court along with the motion of Google for JMOL concerning the range check files. Additionally, the JMOL of infringement was also moved by the Oracle concerning the eight decompiled security files. When the motion was granted, Google has admitted to the court that the eight files we’re indeed copied and no reasonable jury could find that the copying was de minimis. The decision of the district court on copyrightability was then released shortly thereafter wherein the replication of 37 packages elements was found out to be not subjected to the protection of the copyright. This includes the declarations along with the overall sequence, organization, and structure.
