Police are entrusted with the role of protecting citizens by ensuring law and order (Australian Federal Police, 2022). There exist some ideals and legislation to guide them in carrying out their duties. This paper will analyze a scenario to determine how best the police adhered to the ideals and expectations outlined in the NSWP policy and NSW legislation. In addition, the paper will address the concept of police discretion and apply it to the scenario. The paper will also investigate how effective communication skills were applied and how the same would have been done in a better manner.
The police remarkably failed to adhere to the ideals and expectations outlined in NSWP policy and NSW legislation. The first way in which they failed to adhere to these ideals is that they did not offer appropriate care to the woman. For instance, even after realizing that the woman had a little girl, the senior constable did not care about her welfare. The constable showed some care since he suggested to senior constable that they should let the woman go because of the child. The policemen ought to have cared for the welfare of the woman and her child. From the case study, it is apparent that the woman had received poor services from the shop and her complaints were valid. As a result, it would have been appropriate for the police to listen to her side of the story before reaching a conclusion on what to do.
The second way in which the police failed to uphold the ideals and expectations was through their failure to act diligently. For instance, the senior constable concludes that the woman must be from a lower social-economic status because she uses slang. He continues to conclude that she must be part of the public housing scheme. Police should act diligently by not judging a person from mere looks (ALRC, 2022). They should instead focus on facts. The third way the police failed to uphold the ideals and expectations was by propagating unfair treatment. First, the police fail to ensure a fair hearing. They take the word of the manager as supreme and fail to listen to the concerns of the woman. In fact, the police concluded that the woman should be taken to the station for the use of slang, yet they failed to address her concerns.
Police discretion refers to the liberty bestowed upon police officers to make certain decisions when they are performing their official duties (NSW Police Public Site, 2022). When in an official duty, the police officer is granted freedom to make certain decisions to enable them to perform their duties effectively (Vicki & Rebecca, 2022).).
