Ethical Considerations
Each vital member of a court session often faces different ethical problems when some issues about a case arise. The current paper aims to briefly frame and describe some of these critical ethical issues facing lawyers, judges, and the jury.
Professional Conduct (Lawyers)
The main work of lawyers is to represent clients in a court of law because they have an advanced understanding of the law than the layperson. One of the most significant ethical dilemmas lawyers face in their relationship with clients is knowing that they are guilty of a crime while defending them simultaneously as if they were not. In this case, the idea is for the prosecution to prove beyond doubt that the accused is guilty. This is a dilemma because, on the one hand, the Lawyer is supposed to uphold the law and pursue justice. On the other hand, the Lawyer has a responsibility to defend their client whether they are guilty or not (though at this time, it is the Lawyer who has prior information implying that the accused is not guilty until proven so by the court (Asimow & Weisberg, 2008). Nevertheless, the Lawyer's dilemma, it appears, is to defend even the guilty at times.
Why Judges Need to Step Aside
There are times when a judge needs to step aside from a case and when judges are told by the Supreme Court to step aside from a case (Johnson & Parton, 2020). Among the critical reasons for this is when a conflict of interest emerges. For example, if a judge is friends with an accused client and they spent time together before a court hearing, then there is a chance that a conflict of interest will emerge.
