Understanding the various roles and perspectives of the justice system is essential for its effectiveness. It allows policy-makers to craft effective laws and guide law enforcement in their implementation. Accordingly, this article will focus on the various perspectives of the criminal justice system, according to Siegel and Worrall.
Perspectives on the Criminal Justice System
According to Siegel and Worrall (2017), there are six perspectives of criminal justice which include (1) crime control perspective, (2) rehabilitation perspective, (3) due process perspective, (4) non-intervention perspective, (5) "Equal" justice perspective, and (6) Restorative justice perspective.
First, the crime control perspective believes that one of the primary purposes of the criminal justice system is to prevent citizens from committing any crime under the pain and fear of criminal sanctions.
Second, the rehabilitation perspective believes that the primary goal of the criminal system is to turn the life of the accused (or perpetrator) and to help them overcome any psychological or personal issues. In other words, this perspective believes that the primary goal of the justice system is to improve their lifestyle.
Third, the due process perspective believes that the criminal justice system provides individuals with a fair avenue to defend themselves against any accusations against them. This is contrary to early systems of justice wherein the accused may be held guilty even before proven otherwise.
Fourth, the non-intervention perspective believes the justice system's purpose is to thresh out the truth and provide justice without siding with anyone but based only on the ultimate facts and the applicable law.
Fifth, the equal justice perspective aims to eliminate any inconsistencies and inequality in the treatment of the accused. It believes that the justice system and its consequences should be applied equally and without bias to ever...
