You're employed by a private consulting firm, Juvenile Administration, which specializes in the field of juvenile justice in all its applications. Your firm is often retained by school districts and municipalities to advise them on the law and to suggest solutions for specific issues and problems in this most important and complex area.
Juvenile Administration has been retained by your local school district, which is interested in revamping many of the procedures that it currently has in place concerning its administration of various juvenile justice issues. For this project, you don't have to research the procedures being used by your local school district. Assume that the district wants to operate from a clean slate and is interested in a wide array of information you must supply, even if it's already employing some of the methods and procedures included in your information.
The managing partner in your firm assigns you as the chief project manager for this client. After many weeks of meetings with the members of the school district's administrative board, you've been able to catalog their concerns into four major categories.
Assignment 4: Law and Procedures
Issues
The school district wants to ascertain the applicable law and procedures that govern juvenile crime and the courts. You must research and inform the district officials about both federal and state laws. They're interested in the types of courts used, the differences in procedures for juveniles and adults, as well as the juvenile sentencing options. They also want to learn the circumstances that would lead a juvenile offender to be treated as an adult.

Juvenile offenders in Saint Croix are increasing at an alarming rate every day. The phenomenon has raised genuine concerns among parents, teachers, and education officers. The concerns touched on the laws and procedures that govern the juvenile justice system. For instance, they sought to know the circumstances that would lead to the treatment of juveniles as adults. The officers, on the other hand, needed to know when and how they could conduct searches on students without breaking the law.
Laws and Procedures
In most states, an individual can only be criminally culpable after attaining the age of 18 years. On the flip side, the law regards those who fall under that age as juveniles. The laws and procedures followed in solving their offenses are different. This is based on the premise that youth are essentially different from adults regarding the level of responsibility (Impact Law, 2022). The main goal of the juvenile justice system is to treat and reintegrate them into society. As such, juvenile laws are flexible to a considerable degree, and decisions are made with the interests of both the state and the juveniles in mind. The procedure followed often has eight steps: arrest, intake, diversion, detention, waiver, adjudication, disposition, and aftercare. The fundamental law that both state and federal governments use is the Juvenile Justice and Delinquency Prevention Act which was passed into law in 1974 (Impact Law, 2022). The act has since undergone several amendments and additional programs to move with the changing times. However, states have their own different laws that govern their juvenile justice systems.
Differences in Procedures for Juvenile and Adults
The treatment of juvenile offenders differs fundamentally from that accorded to adults in several ways. The differences start right from the time of the arrest to the sentencing (Williams, 2021). In this regard, the terminologies used in the two instances are quite different. For instance, an adult is arrested, while a juvenile is taken into custody. In addition, an adult is entitled to bond, while juveniles do not enjoy that right. They can be held in custody while the court process lasts.
